Use of the Website and App
If you use our website for information purposes only, i.e. you do not contact us directly, do not register for the app, the newsletter, courses or membership, and do not order products, we only collect the personal data that your browser transmits to our servers. We collect the following data in the form of log files, which are technically necessary to display our website to you and to ensure stability and security:
- Date and time of access
- URL of the website or file accessed
- Status code of the request
- Volume of data transmitted
- Browser type and version
- Operating system of the user
- Referrer URL (source from which you visit us)

Newsletter subscription
If you subscribe to our newsletter, this is done using a double opt-in procedure, i.e. on the basis of your consent. After registering via this website, you will receive an email asking you to confirm your subscription. This confirmation is necessary to ensure that you genuinely wish to subscribe. This process is logged in order to be able to document the subscription procedure.
If you register on our website in order to continue to access our content free of charge, you thereby also agree to subscribe to the newsletter. You can unsubscribe from the newsletter at any time using the link provided in the footer of each newsletter.
During the subscription process we collect the following personal data:

You may cancel your newsletter subscription at any time. A corresponding link is provided at the end of each newsletter. You can also unsubscribe from the newsletter in your profile on the ellexx website and in the ellexx app.
When you open the newsletter, a small embedded graphic establishes a connection to the server. This enables the collection of technical information such as browser and system version, your IP address and the time of access. It is possible to determine whether and when newsletters are opened and which links are clicked. From a technical perspective, this information could be associated with individual recipients. However, we have no interest in monitoring individual users. We analyse this information in anonymised form in order to understand reading habits, analyse open rates and optimise our newsletter.
The newsletter is sent using “Friendly”. For this purpose, your email address and further information for newsletter analytics are stored there. Further information on Friendly’s data protection measures can be found here:
Use of the App
If you register to use the ellexx app, we collect the following personal data:
- Master data (e.g. name, email address, telephone number or location)
- Technical data (e.g. IP address, type and version of browser plug-ins, cookies, internal and external identifiers, log data, access and change logs, content retrieved by users of the app, including date and time of access, business/account number)

Contact requests and our services
If you wish to use other services available on our website, we may collect and process the following personal data for the provision of such services:
- Personal data such as name, telephone number, residential and billing address, email address, gender, date of birth
- Identifiers that we assign to you, such as customer, contract or membership numbers, including identifiers for accounting purposes
- Financial information, including payment and transaction records
- Where applicable, professional information about you such as education, job title and professional experience
- Where applicable, information about your personal circumstances, such as marital status and children
- Interactions with you and the products and services you use, as well as the member profile you create

3. Purposes of Data Processing
In accordance with applicable data protection law, ellexx may process personal data in particular for the following purposes:
- To provide our website and app
- To provide the protected area on our website and in our app for registered users (in accordance with our GTC)
- To carry out activities related to a contract we have concluded with you (e.g. in connection with a membership, course registration or shop order), such as making bookings, processing payments, performing credit checks, delivering to the address provided (if items are to be shipped) and, where applicable, processing cancellations or refunds, as well as activities relating to pre-contractual measures, e.g. in the event of enquiries about our services
- To communicate with you about your enquiries that are not related to a contract
- To send you direct marketing communications and newsletters about our services
- To provide our existing customers with information and offers which we believe match their interests because they are similar to previous purchases
- To provide you with the “stay logged in” option
- To continuously improve the services we offer, based on an analysis of usage data collected on our website/app on a pseudonymised basis and on evaluating the availability and speed of our website
- To analyse usage data collected on our website/app for interest-based advertising
- To enable users to apply for jobs via the careers section of the website
- To carry out market research activities on the basis of information relating to our existing customers (name and email address obtained in connection with our business relationship)

4. Sources of Personal Data
For the purposes described in section 3, we may collect your personal data, within the limits of the law, from various sources. These sources include both direct interactions with you and information provided to us by third parties or via technical infrastructures. We always ensure that data is collected in accordance with applicable legal provisions.
- Direct information: As a rule, we collect personal data directly from you in the context of the business relationship or when you use our services.
- Third parties or publicly available sources: We also collect personal data from third parties such as banks and financial service providers, as well as from publicly available sources such as the internet, print and electronic media, social networks, commercial registers, public registers, authorities, professional compliance databases and other information services.
- Automated technologies or interactions: During electronic interactions, we may automatically collect personal data through the use of cookies or similar technologies.
5. Legal Basis for Processing Personal Data
The processing of personal data is carried out in accordance with applicable data protection provisions and, where required and depending on the purpose of the processing, may be based on one of the following grounds:
- Performance of contractual obligations: We process personal data in order to provide our services or to take pre-contractual steps.
- Compliance with a legal obligation or performance of a task carried out in the public interest: We process personal data in order to comply with our legal and/or regulatory obligations.
- Legitimate interests: In some cases, we process personal data in order to safeguard our legitimate interests or those of a third party, where this does not unduly affect your interests, fundamental rights and freedoms. These interests include, for example:

ellexx takes the necessary measures to ensure that only authorised personnel and auxiliary persons with the required knowledge have access to your personal data in order to fulfil the purposes for which your personal data was collected.
We may disclose your personal data, in line with the purposes described above, to the following categories of recipients, to the extent necessary for the intended processing:
- Service providers or other business partners who process personal data on behalf of and in accordance with the instructions of ellexx (processors), e.g. in the areas of IT, hosting and support
- External advisers and business partners in relation to our services
- Postal service providers
- External auditors and lawyers
- Authorities and courts
We carefully select our partners and processors and only engage them if we are satisfied that they have appropriate technical and organisational measures in place that meet legal requirements. Our processors may only process personal data on our documented instructions. They are all bound by confidentiality and may only use your personal data to the extent necessary to fulfil the purpose for which your personal data was collected, unless otherwise required by law.
7. Transfer of Personal Data Outside the EU / EEA
As a rule, ellexx processes and stores personal data on servers in Switzerland or in the European Economic Area (EEA). Where necessary and legally permissible, we may also transfer your personal data to recipients, such as business partners, located outside Switzerland and the EEA, in a country that does not provide an adequate level of data protection.
If personal data is transferred to a country without an adequate level of data protection, we ensure appropriate protection by implementing suitable safeguards, such as the use of EU Standard Contractual Clauses, as recognised and supplemented by the Swiss Federal Data Protection and Information Commissioner (FDPIC).

8. Security Measures
We take the protection of your personal data very seriously and have implemented various technical and organisational measures to protect your data when using our website and the associated functions and services. These security measures include, among others, encryption of data transmission between browser and server (HTTPS) and secure transmission of emails (SSL/TLS). We recommend that you also enable SSL/TLS in your email programme. Please note that security gaps in data transmission over the internet can never be completely ruled out.
For the ellexx app, all data transmitted between your device and our servers is protected by modern encryption technologies, such as Secure Socket Layer (SSL) or Transport Layer Security (TLS) protocols. This encryption ensures that your data is protected against unauthorised access during transmission.
We use robust encryption algorithms to protect your data during storage as well. All sensitive data is stored in encrypted form in our database to ensure that it can only be accessed by authorised persons.
9. Data Retention
We store your personal data for as long as is necessary to achieve the respective processing purpose or for as long as we have a legitimate interest in continued storage. We delete personal data, taking into account statutory retention periods, whenever there is no longer any obligation to retain it.
Your email address and, where applicable, your name and telephone number are stored by us in order to answer your queries. We delete the data when it is no longer required or restrict processing where statutory retention obligations exist.
When using the ellexx app, we process information about you in connection with the normal operation of an app. In addition, as a member of our community you may complete your Moneytype and enter your contact details, which are used to create your member profile and your personal preferences within the app. On the basis of the information you provide, we personalise the content in the app for you.
10. Rights of Data Subjects
As a data subject, you have the right at any time to obtain information about, and to request the rectification or deletion of, your data, provided that ellexx is not permitted or legally required to continue storing it, and you have the right to restriction of processing or to object to processing, as well as a right to data portability. Where we process your personal data on the basis of your consent, you also have the right to withdraw this consent at any time with effect for the future.
You also have the right, where we make automated individual decisions that may have legal effects concerning you, to speak to one of our representatives and request a review of such decision. In that case, certain automated services may no longer be available to you.
To exercise your data subject rights, to obtain further information about the processing of your personal data by us, or to submit suggestions or complaints, you are welcome to contact us at the contact address specified above.
Furthermore, you have the right (where applicable) to lodge a complaint with the competent data protection supervisory authority.
11. Cookies
Like almost all websites, we use cookies. These are small text files that are stored on users’ devices. Session cookies are automatically deleted when the browser is closed. Other cookies have a later expiry date or remain permanently stored in order to recognise your browser on your next visit.
We use cookies to enable certain functions and to make browsing more pleasant for you. We also use cookies to analyse how our website is used. 12. Social Media
We maintain online presences within social networks and platforms in order to communicate with customers, interested parties and users who are active there and to inform them about our services. When accessing these networks and platforms, the terms and conditions and data processing guidelines of the respective providers apply.

13. Google Analytics
The website ellexx.com and the ellexx app use Google Analytics, a web analytics service provided by Google LLC. Google processes the information on our behalf, provides us with reports on activities on our website and in the app, and renders further services so that we can analyse and optimise the use of our online offering. Pseudonymous usage profiles of users can be created from the processed data.
We use Google Analytics with IP anonymisation. This means that the IP address of users is shortened by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. The IP address will not be merged with other Google data.

14. Friendly
The website ellexx.com and the ellexx app use Friendly Automate, a Swiss provider for customer data management and email dispatch. Your contact details (e.g. first name, last name, email address, postal address, telephone number, date of birth) that you submit to us using a completed form when purchasing an ellexx membership, ellexx product or ellexx service are recorded in Friendly. Friendly Automate complies with the Swiss Data Protection Act (nDSG) and the EU GDPR. All of your data is hosted in Switzerland by local providers. More information is available here:
15. Firebase
In connection with the ellexx app, we use Firebase. Firebase service data is personal data that Google collects and generates during the provision and management of Firebase services. Examples of Firebase service data include information on service usage, resource identifiers such as application IDs and package/bundle IDs, technical and operational details of usage such as IP addresses and device information and crash logs, as well as direct communication with developers arising from feedback and support conversations.

16. Eventbrite and Zoom
We manage addresses, reservations and course administration using the software Eventbrite and Zoom. We record in these systems the data you provide to us via completed registration forms, by email or by telephone/orally. In addition to your contact details (first name, last name, residential and billing address, telephone number and email address), we record attendance and course times. Depending on requirements, additional personal data may be requested and stored.

17. Typeform
We sometimes conduct surveys and registrations (e.g. for asset management registration) using TYPEFORM S.L., Carrer Bac de Roda, 163, 08018 Barcelona (typeform.com). This plug-in allows us to offer you an interactive contact form. Your responses are stored on typeform.com. Typeform’s data is stored using Amazon AWS services. 18. Payments
We use payment service providers in order to process your payments securely and reliably. The terms of the respective payment service providers (such as General Terms and Conditions or Privacy Policies) apply to payment processing.
In particular, we use Stripe to process payments. Providers: Stripe Inc. (USA) / Stripe Payments Europe Limited for individuals in Europe. Information on data protection: Stripe Privacy Center, Privacy Policy, Cookie Policy.
All payments for in-app purchases are processed via the in-app payment systems of Apple or Google. When you make a purchase within the app, you agree to the payment terms of Apple or Google respectively. For purchases in our shop or for our consulting services, we also use Stripe as a payment service provider within the ellexx app. The payment terms mentioned above apply.
19. Shop
We process purchases via our e-shop using the providers Ecwid and GiftUp. We collect the data you provide there for the shipment of ordered goods and for payment processing. The terms of these providers also apply to the use of Ecwid and GiftUp:

20. B2B
