General Terms and Conditions (GTC)


1. Scope of Application


1.1. These General Terms and Conditions (GTC) apply to you if you purchase a subscription (Membership) on the digital platform "ellexx" or via the ellexx App from ellexx universe AG, visit the website www.ellexx.com, or use the App (visitor), and for all other contractual relationships you enter into with ellexx universe AG, for example, if you shop in our e-shop. Contractual relationships you may enter into with one of our cooperation partners are not covered by these GTC.

1.2. ellexx universe AG operates the website www.ellexx.com and the ellexx App, where you can purchase a monthly or annual membership on the digital platform "ellexx" from ellexx universe AG, either as a natural or legal person. Additionally, ellexx operates an e-shop. The GTC apply to all orders and purchases you make on the website www.ellexx.com or via the App, in their current version at the time of the order.

1.3. To purchase a membership, you must be a fully legally competent natural person (minimum age 18 years) or a legal person registered in the commercial register. If you are under 18 years old, you need the written consent of your legal guardians or representatives to purchase a membership.

1.4. By using the website www.ellexx.com or the App as a visitor, you agree to these GTC. Usage occurs whenever you access the websites www.ellexx.com or use the App. To purchase a membership from ellexx, you give your active consent to these GTC by clicking the checkbox. Once you become a member, we will also send you our newsletters. You can unsubscribe at any time.
1.5. Terms of Use ellexx App (EULA):

The software applications of ellexx universe AG and their content are neither sold nor transferred to you, and all rights to reproductions of ellexx software applications and content remain with ellexx and its licensors even after installation on your computer, tablets, mobile devices, and/or other devices.

For the use of the ellexx App via the Apple Store, we also refer to the Licensed Application End User Agreement (EULA) from Apple. This is an agreement between Apple, us as the provider, and you as the user. In summary, when you download an app, it does not belong to you but you receive a license to use the app. This also applies to the ellexx App. The Standard User License Agreement regulates under what conditions you can use the app, data usage, and other points that you should read yourself if interested.

2. Scope of services

2.1. ellexx universe AG operates the platform www.ellexx.com and the ellexx App, where you can subscribe to a membership of "ellexx" or read the freely accessible information. ellexx universe AG is responsible for the content of the website and the App. Exceptions are product pages created in cooperation with our partners.

2.2. Copyright and usage rights always remain with ellexx universe AG.



2.3. You are solely responsible for deciding whether you want to subscribe to a membership with "ellexx" or enter into a contractual relationship with one of our partners.

2.4. If you decide to purchase a product from our partners, you acknowledge and accept that we may receive commissions, retrocessions, compensation, or other benefits (compensation from third parties) from our partners in connection with the services provided to you. You waive any claims regarding these compensations from third parties and acknowledge that we may retain these as compensation for our services.

2.5. Membership via ellexx App
You can purchase a membership for the "App" starting from June 11th in the ellexx App. There are three different memberships to choose from:

  • Basic (2.5.1) Annual membership
  • Plus (2.5.2) Monthly or annual membership
  • Supporter (2.5.3) Annual membership

2.5.1 Basic Membership
For the Basic Membership in the ellexx App, you get the following services for one year:

  • Access to all content
  • Newsletter for members
  • All interactive checklists
  • 20% off offers from other female founders
    All for CHF 169 per year including VAT.

2.5.2 Plus Membership
For the Plus Membership in the ellexx App, you get the following services either for a month or as an annual membership:

  • Access to all content
  • Newsletter for members
  • All interactive checklists
  • Plus long versions for download
  • 20% off offers from other female founders
  • Your smart budget tool in the App
    Additionally:
  • All live coachings, which are 11-24 coachings per year on money matters with top experts and the founders
  • Motivating online courses on investing and retirement planning for beginners and advanced users
  • 20% discount on Close the Gaps Night and ellexx Money Hacks course
    All for CHF 199 per year or CHF 19 per month (including VAT).

2.5.3 Supporter Membership
For the Supporter Membership in the ellexx App, you get the following services for one year:

  • Access to all content
  • Newsletter for members
  • All interactive checklists
  • Plus all long versions for download
  • 20% off offers from other female founders
  • Your smart budget tool in the App
  • All live coachings, which are 11-24 coachings per year on money matters with top experts and the founders
  • Motivating online courses on investing and retirement planning for beginners and advanced users
  • 20% discount on Close the Gaps Night and ellexx Money Hacks course
  • Exclusive: Two tickets to Close the Gaps Night on September 27th in Zurich
  • Exclusive: Superwoman silk scarf from ellexx – because you are one!
  • Exclusive: Close the Gaps book with a personal dedication from the founders
  • Eternal love from the ellexx team 💜

    All for CHF 499 per year including VAT.

2.6. Membership on ellexx.com
You can purchase the membership for "ellexx" until June 10th, 2024, on ellexx.com. The membership "ellexx" like www.ellexx.com is accessible until June 2025. From July 2025, access to membership is only possible via the ellexx App (see your benefits of the App Membership under 2.5.). Your existing membership with "ellexx" will be converted to a new membership after the previous subscription expires. That means: Your access to the App is valid at the old price of the membership for "ellexx" until the end of your previous subscription. Your previous membership with "ellexx" will be converted into a new "App" Plus Membership after the expiration of the previous subscription if you do not cancel at least two days before. Example: If you purchase an "ellexx" membership on June 10th, 2024, you can use the services on both ellexx.com and in the App at the previous price, with the annual membership still valid for one year and the monthly membership for one month.

As a member on "ellexx," you have access to the following services:

  • Access to all checklists
  • Access to premium content (video tutorials)
  • ellexx newsletter
  • 20% discount on all ellexx events (such as the Money Hacks course or the Close the Gaps Night)
  • Discount at other companies founded or run by women
    A part of the membership income is donated by ellexx universe AG to projects that empower women. Another part of the profit is invested by ellexx universe AG as angel investors in start-ups. However, this does not give you any legal or factual claim to proof of this donation or investment. ellexx universe AG is free to choose the recipients of the amount to be donated or invested. Recipients of such donations or investments acquire no legally valid claim to payment. The cost of the "ellexx" membership (via ellexx.com) is CHF 131 per year or CHF 13 per month including VAT.

3. Payment, commissions and fees

3.1. Before transferring for your membership, you will be asked to provide your name, first name, and email address.

3.2. Your payment as a member for a membership is credited to the account of ellexx universe AG. Any transaction fees will be deducted from the payment. The fees depend on the chosen payment method.

3.3. As a member, you agree that ellexx universe AG can commission independent third parties to collect a payment from you into a Swiss account. For this purpose, you will be redirected to a payment provider via an electronic payment gateway.

3.4. The amounts paid by you as a member are freely available to ellexx universe AG.

3.5. If your payment relates to an ongoing membership, the amount will be debited upon conclusion of the membership and subsequently every month/year in advance. The membership is automatically renewed until canceled. If we cannot collect the amount from the specified payment method, we will close access to the annual membership after two weeks and the monthly after three days after several attempts to collect the amount.

4. Duration, Termination, and Refund

4.1. Automatic renewal: Unless expressly stated that the membership should not be continued, the subscription or your membership is automatically renewed each year/month without further notice. The automatic renewal applies to the ellexx membership on ellexx.com as well as to the memberships in the App (Basic, Plus, and Supporter).

4.2. Termination: You must electronically notify us (via email to hello@ellexx.com or through the membership portal or in the ellexx App) of non-renewal of memberships at least two (2) business days before the renewal of the subscription. An unpaid membership does not count as a termination.

4.3. Refund: A refund of a redeemed membership is not possible.

5. Data Usage and Data Protection

The following privacy policy is an integral part of these GTC.

6. Obligations as a Member

6.1. You are responsible for the content of your registration as a member and for the information you provide about yourself on ellexx.com or through the ellexx App. You confirm that the information you provide is complete and truthful.

6.2. As a visitor to ellexx.com, user of the ellexx App, or member, you are obliged to indemnify ellexx universe AG from any type of costs, claims, damages, losses, or other demands arising from your registration, use, or visit to the website www.ellexx.com or the ellexx App, or for other reasons.

7. Shop

7.1. In the e-shop and in the shop in the ellexx App, you place an online order. The order is binding when you agree to the GTC and press the "Order Now" button. This creates a legally valid purchase contract between you and ellexx. After receiving your order, you will receive an order confirmation by email.

7.2. After the order confirmation, we will send you the ordered items to the delivery address you specified. External factors such as natural events, delayed processes with delivery partners can extend the delivery period. If the delivery of the goods fails despite several delivery attempts, ellexx may withdraw from the contract. Obvious errors in the delivery of goods must be reported under OR Art. 6a and returned to us.

7.3. Our offer in the e-shop is non-binding. Usually, the items offered in the e-shop are available. If it is not possible to deliver one or more items due to a stock discrepancy, we will inform you as soon as possible. The paid amount will be refunded to you in this case.

7.4. Our sales prices are ex-warehouse and are in Swiss francs, including the statutory VAT and excluding shipping costs.

7.5. For orders in our e-shop, the payment options specified there are available to you.

7.6. We deliver exclusively to Switzerland. You as the buyer bear the shipping costs. We only charge the actual postage costs. These are visible at the end of the checkout process in the shopping cart.
We reserve the right to commission companies other than the Swiss Post for delivery or to deliver orders ourselves; the shipping costs will not be refunded. Self-collection is not possible.
The ordered goods remain the property of ellexx until full payment is made.
Gift vouchers ordered by you cannot be returned.

7.7. You can cancel the contract within 10 days after receiving the goods with a description of the return reason by returning the goods. The return of the goods is at your own risk and expense.

Only items that are unworn, intact, and in perfect condition will be accepted. Especially worn, soiled, damaged, or smelly products cannot be returned. If this is not the case, we reserve the right to assert claims for compensation.

You can deduct the amount of a return item from any total amount. If the total amount has already been transferred to us, we will refund the corresponding amount to the same payment method. The shipping costs will not be refunded.

7.8. We ask you to check the delivered items immediately for accuracy, completeness, and integrity. Complaints about delivery scope, defects, wrong deliveries, and quantity deviations must be reported to us in writing by email to hello@ellexx.com within 5 working days after receiving the goods. The defect will be gladly checked by us. If the defect is accepted, we will send you a replacement item if available. Otherwise, the entire amount will be refunded to you. Our warranties for purchased items are limited to the assurances of the respective manufacturer. If you handle the products improperly or have personally altered them, the claim for defects expires.

8. Disclaimer of Liability

8.1. ellexx universe AG assumes no liability for the content accuracy, precision, timeliness, reliability, and completeness of the information. Liability claims against ellexx universe AG for material or immaterial damages arising from access or use or non-use of the published information, misuse of the connection, or technical disruptions are excluded.

8.2. All offers are non-binding. The displayed information on financial and insurance products does not constitute investment advice or other personal advisory services and is directed exclusively at persons residing in Switzerland.

8.3. ellexx universe AG expressly reserves the right to change, supplement, delete parts of the pages or the entire offer without prior notice or to cease publication temporarily or permanently.

8.4. References and links to third-party websites are outside our area of responsibility. We reject any responsibility for such websites. Access and use of such websites are at your own risk.

8.5. Claims for damages due to impossibility of performance, breach of contract, fault at contract conclusion, and unlawful acts are entirely excluded against ellexx universe AG and their fulfillment or vicarious agents unless intentional or grossly negligent actions are present. Liability for indirect damages or consequential damages is waived.

8.6. ellexx universe AG also assumes no liability for third-party services obtained in the context of contract fulfillment. It also does not assume liability for damages that visitors or members suffer from the behavior of other users.

9. Provision of Educational Content

ellexx offers visitors various educational content including but not limited to articles, videos, podcasts, coaching, and webinars (live and recorded), newsletters, structured learning courses, checklists, and surveys. Some content is accessible to all visitors of ellexx.com or the ellexx App, while other content may be restricted to members.

In all cases, the content provided to you is for educational purposes only, does not constitute (regulated or other) financial advice, and should not be construed as such. You, as a visitor or user, are solely responsible for your financial, personal, business, or other actions, and ellexx cannot be held legally or financially responsible for your actions or decisions under any circumstances.

You, as a visitor, user, and/or member, are aware that ellexx – even if ellexx has financial and legal expertise – is not a regulated entity by the Swiss Financial Market Supervisory Authority (FINMA) (or an equivalent authority) (i.e., not a bank, not a bank advisor, not a wealth manager, etc.). All content, coaching, or other assistance we offer you is not regulated financial advice, and therefore, under no circumstances do you have the right to claim financial advice from ellexx.
You also agree and are aware that no part of the ellexx platform, the ellexx App, or the services provided ever constitutes another form of professional advice, such as investment advice, legal advice, tax advice, or accounting advice. Therefore, ellexx expressly disclaims any professional liability in this regard to the fullest extent permitted by law.

ellexx is never responsible or liable for your financial situation as a visitor or member. Your financial decisions, losses, or other actions are your own responsibility, and you are aware and expressly agree to the extent and limitations of the role and purpose of ellexx.
The information on this homepage or within the ellexx App, which is not expressly marked as an offer (with reference to term sheets, base prospectuses, or key information documents), is considered advertising within the meaning of Art. 68 para. 1 FIDLEG and serves informational purposes only. It is directed exclusively at persons residing in Switzerland. It does not constitute personal advice or any other financial service within the meaning of FIDLEG.

10. Copyrights

The copyrights and all other rights to content, images, photos, or other files on the website belong exclusively to ellexx universe AG or the specifically named rights holders. Written consent from the copyright holders must be obtained in advance for the reproduction of any elements.

11. Severability clause

Should individual provisions of these GTC be wholly or partially invalid or become invalid, this shall not affect the validity of the remaining provisions and the validity of the contracts based on them. The invalid regulation is to be replaced by the parties with a valid one that comes as close as possible to the economic purpose of the invalid regulation. The same applies to any gaps in the GTC or the contracts based on them.

12. Jurisdiction, Applicable Law

The applicable law for these GTC and the contracts based on them between you as a visitor to ellexx.com or the ellexx App or member with ellexx universe AG is exclusively Swiss law, excluding the conflict of laws provisions and the provisions of the UN Sales Convention (CISG).

The exclusive place of jurisdiction is Zurich.

13. Changes to the GTC

ellexx universe AG reserves the right to change the GTC at any time without giving reasons. The changed GTC apply from the date of publication on the website www.ellexx.com or in the ellexx App.

2. Collection of personal data

Use of the website and app

If you use our website for information purposes only, i.e. if you do not contact us directly, register for the app, newsletter, courses or membership or order products, we only collect personal data that your browser transmits to our servers. We collect the following data in the form of log files, which are technically necessary for us to display our website to you and to ensure stability and security:

  • Date and time of access;
  • URL of the accessed website or requested file;
  • Status code of the request;
  • Amount of data transferred
  • Browser type incl. version;
  • Operating system of the user(s);
  • Referrer URL (source from which you are visiting us);
  • IP address of the requesting computer;
  • Requesting provider.

Newsletter registration

If you register for the newsletter, this is done using a double opt-in procedure, i.e. with your consent. After registering via this website, you will receive an email asking you to confirm your registration. This confirmation is necessary to ensure that you really want to register. This process is logged in order to be able to prove the registration process.

We collect the following personal data during the registration process:

  • First name and surname;
  • e-mail address.

We collect this additional data as part of the logging process:

  • the receipt of the reply e-mail;
  • the dispatch of the confirmation email;
  • acceptance of our privacy policy and terms and conditions
  • consent to receive newsletters.

You can cancel your newsletter subscription at any time. You will find a corresponding link at the end of each newsletter. 

When you open the newsletter, a small embedded graphic establishes a connection to the server. This collects technical information such as browser and system version, your IP address and the time of access. It is possible to determine whether the newsletters are opened, when they are opened and which links are clicked on. Technically, this information could be assigned to individual recipients. However, we have no interest in monitoring individual users. We evaluate the information anonymously in order to identify reading habits, analyse opening rates and optimise our newsletter.

The newsletter is sent using Friendly. For this purpose, your e-mail address and other information about the analysis of the newsletter is stored. Further information on Friendly's data protection precautions can be found here: https://friendly.ch/en/privacy 

Use of the app

When you register to use the ellexx app, we collect the following personal data:

  • Master data (e.g. name, email address, telephone number or location).
  • Technical data (e.g. IP address, type and version of browser plug-ins, cookies, internal and external identifiers, log data, access and change logs, content accessed by users of the app, including date and time of access, business/account number).

Contact enquiries and our services

If you wish to use the other services available on our website, we may collect and process the following personal data for the provision of these services:

  • Personal data such as name, telephone number, home and billing address, email address, gender, date of birth;
  • Identifiers that we assign to you, such as customer, contract or membership numbers, including identifiers for accounting purposes;
  • Financial information, including payment and transaction records;
  • If applicable, professional information about you, e.g. education, job title and professional experience;
  • Where applicable, information about your living situation, e.g. marital status, children;
  • Interactions with you and the products and services you use, as well as the member profile you have created.

If you no longer wish to receive advertising targeting when visiting our website as a registered and logged-in member, you can send us an email to data@ellexx.com with the note ‘Please do not receive advertising targeting as a logged-in member’. If you also do not want retargeting when visiting our websites, even if you are not logged in, you can proceed as described below regarding cookies.

3. Purpose of data processing

In accordance with the applicable data protection legislation, ellexx may process personal data in particular for the following purposes:

  • To provide our website and app;
  • To provide the protected area on our website and in our app for registered users (in accordance with our GTC)
  • To carry out activities in connection with a contract we have entered into with you (e.g. as part of a membership, course registration or shop order, to make bookings, process payments, carry out credit checks, deliver to the address provided (if items are to be shipped) and process cancellations or refunds, if applicable) and to carry out activities in connection with pre-contractual measures, e.g. in the case of enquiries about our services;
  • To communicate with you about your enquiries that are not related to a contract;
  • To send you direct marketing communications and newsletters about our services
  • To provide our existing customers with information and offers that we believe will be of interest to you because they are similar to your previous purchases;
  • To provide you with the ‘Stay signed in’ option;
  • To constantly improve the services we offer, based on an analysis of the usage data collected on our website / app on a pseudonymised basis and the evaluation of the availability and speed of our website;
  • To analyse the usage data collected on our website / app for interest-based advertising;
  • To give users the opportunity to apply for jobs via the job search on the website
  • To conduct market research activities based on information relating to our existing customers (name and email address received in connection with our business relationship);

For the purposes described in section 3, we may collect your personal data from various sources to the extent permitted by law. These sources include both direct interactions with you and information provided to us by third parties or via technical infrastructures. In doing so, we always ensure that the collection takes place in accordance with the applicable legal provisions.

Direct information: As a rule, we collect personal data directly from you as part of the business relationship or use of services.

Third parties or publicly available sources of information: We also collect personal data from third parties such as banks and financial service providers as well as from publicly available sources such as the internet, print and electronic media, social networks, commercial registers, public registers, authorities, professional compliance databases and other information services.

Automated technologies or interactions: During electronic interactions, we may automatically collect personal data through the use of cookies or similar technologies.

The processing of personal data is carried out in accordance with the applicable data protection regulations and, if necessary and depending on the purpose of the processing, this may be based on one of the following reasons:

  • To fulfil contractual obligations: We process personal data in order to provide our services or to carry out pre-contractual measures.
  • To fulfil a legal obligation or in the public interest: We process personal data in order to fulfil our legal and/or regulatory obligations.
  • For the purposes of legitimate interests: In some circumstances, we process personal data to protect our legitimate interests or those of a third party, provided this does not unduly prejudice your interests, fundamental rights and freedoms. This includes, for example:
    • Protection and security of our services, systems and assets;
    • Compliance with legal, regulatory and contractual obligations;
    • Assertion, exercise or defence of legal claims;
    • Maintaining and efficiently organising business operations;
    • Improving and developing our services and selling and marketing our services.
  • On the basis of your consent: Once you have consented to the processing of your personal data for specific purposes (e.g. if you have registered for our newsletter), the lawfulness of this processing is based on your consent. Consent can be revoked at any time. The revocation only becomes effective in the future and does not apply to the processing of personal data that took place before the revocation.

6. Recipients of personal data

ellexx takes the necessary measures to ensure that only authorised personnel and auxiliary persons who have the necessary knowledge have access to your personal data in order to fulfil the purposes for which your personal data was collected.

We may disclose your personal data to the following possible categories of recipients in accordance with the purposes of processing described above, insofar as this is necessary for the intended data processing:

  • Service providers or other business partners who process personal data on behalf of and on the instructions of ellexx (so-called processors, e.g. in the areas of IT, hosting and support);
  • External consultants and business partners for our services;
  • Postal service providers;
  • External auditors and lawyers;
  • Public authorities and courts.

We select our partners and processors carefully and only if we are certain that they have appropriate technical and organisational measures in place that meet the legal requirements. Our processors may only process personal data on our documented instructions. They are all subject to a duty of confidentiality and may only use your personal data to the extent necessary to fulfil the purpose for which your personal data was collected, unless this is required by law.

7. Transfer of personal data outside the EU / EEA

ellexx generally processes and stores personal data on servers in Switzerland or the European Economic Area. If necessary and legally permissible, we also transfer your personal data to recipients, e.g. business partners located outside Switzerland and the European Economic Area (EEA), in a country that does not guarantee adequate data protection. If personal data is transferred to a country without adequate data protection, we ensure adequate protection by using sufficient guarantees, such as on the basis of the EU standard contractual clauses, which have been recognised and supplemented by the Federal Data Protection and Information Commissioner (FDPIC).

Questions about such data transfers and which guarantees are applied in specific cases can be directed to the above contact address at any time.

8. Safety measures

We take the protection of your personal data very seriously and have taken various technical and organisational measures to protect your data when using our website and the associated functions and services. The security measures include encrypting data transmission between the browser and server (HTTPS) and sending e-mails securely (SSL / TLS). We recommend that you also activate SSL / TLS in your e-mail programme. We would like to point out that security gaps in data transmission on the Internet can never be completely ruled out.

With the ellexx app, all data transmitted between your device and our servers is protected by modern encryption technologies, such as the Secure Socket Layer (SSL) or Transport Layer Security (TLS) protocols. This encryption ensures that your data is protected from unauthorised access during transmission.

9. Data retention

We store your personal data for as long as this is necessary to pursue the respective processing purpose or as long as we have a legitimate interest in further storage. We delete personal data in compliance with statutory retention obligations whenever there is no longer an obligation to continue storing it.

We store your e-mail address and, if applicable, your name and telephone number in order to answer your questions. We delete the data when it is no longer required or restrict processing if there are statutory retention obligations. 

When you use the ellexx app, we process information about you in connection with the normal operation of an app. In addition, as a member of our community, you can fill in your Moneytype and add your contact details, which is used to create your member profile and your personal preferences within the app. We customise the content in the app for you based on your details.

10. Data subject rights

As a data subject, you have the right to information, correction and deletion of your data at any time, provided that ellxxe is no longer allowed to store it or is not legally obliged to store it, as well as the right to restrict or revoke processing and the right to data portability. If we process your personal data on the basis of your consent, you also have the right to withdraw this consent at any time with effect for the future. In addition, if we make automated individual decisions that may have legal consequences for you, you also have the right to speak to one of our representatives and request a review of this decision. In this case, you will no longer be able to use the specific automated services.

13. Google Analytics

Google Analytics, a web analytics service provided by Google LLC, is integrated into the ellexx.com website and the ellexx app. Google processes the information on our behalf, provides us with reports on the activities on our website and in the app and provides other services so that we can evaluate and optimise the use of our online offering. Pseudonymised user profiles can be created from the processed data.

We use Google Analytics with IP anonymisation. This means that the IP address of users is truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. The IP address will not be merged with other Google data.

14. Friendly

The ellexx.com website and the ellexx app use Friendly Automate, a Swiss provider for managing customer data and sending e-mails. Friendly collects your contact details (e.g. first name, surname, email, address, telephone number, date of birth), which you submit to us by completing a form when you sign up for an ellexx membership, an ellexx product or an ellexx service. Friendly Automate is compliant with the Swiss nDSG and the EU GDPR. All your data is hosted in Switzerland with local providers. You can find more information here: https://friendly.ch/en/privacy 

15. Ghost

We use Ghost in connection with the management of membership data (Free, Basic, Plus and Supporter). In this programme, we collect your contact details (first name, surname, email), which you provide to us by completing a form.

16. Firebase

We use Firebase in connection with the ellexx app. Firebase service data is personal data that Google collects and generates during the provision and management of Firebase services. Examples of Firebase service data include service usage information, resource identifiers such as application IDs and package names / bundle IDs, technical and operational details of usage such as IP addresses, and direct communication with developers from feedback and support calls.

17. Eventbrite and Zoom

Our address, reservation and course administration is managed via the Eventbrite or Zoom software. We record your data in this programme, which you provide to us by completing the registration form, by e-mail or by telephone / verbally. In addition to your contact details (first name, surname, home and billing address, telephone number and e-mail address), the attendance and course times are recorded. Additional personal data may be requested and stored as required.

Thanks to this plugin we can offer you an interactive contact form. Your answers will be stored on typeform.com. Typeform's data is stored on the Amazon AWS service. 19. Payments

We use payment service providers to process your payments securely and reliably. The terms and conditions of the relevant payment service providers, such as general terms and conditions or data protection declarations, apply to processing.

All payments for in-app purchases are processed via the Apple or Google in-app payment system. When you make a purchase within the app, you agree to the payment terms of Apple or Google. For purchases in our shop or our consulting services, we also use Stripe as a payment service provider within the ellexx app. The above payment terms apply.

20. Shop

We process purchases via the e-shop via the providers Ecwid and GiftUp. We collect the data you provide there to dispatch the ordered goods and to process the payment. The terms and conditions of these service providers also apply to the processing and use of Ecwid and GiftUp:

Legal Information Regarding Fidleg

We retain the compensations we receive as remuneration for the marketing of services from our cooperation partners. This is how we finance our content. Therefore, you will not find banners and flashing ads on our platform.

Your waiver of refund

According to Article 2.4 of our General Terms and Conditions, you waive the reimbursement of distribution compensations and other remunerations from third parties that we have received in the past and can receive in the future.

The distribution compensations that can accrue to us at most are:

ellexx Pillar 3a: At a bank fee of 0.48%, these are shared equally between Vontobel and us. We are entitled to 0.24% for our cooperation with Vontobel.

Migros Bank ellexx Tracker Certificate: At a fee of 1.1%, the issuer (ZKB) receives 0.3%. The remaining 0.8% is shared equally between Migros Bank and us. We are entitled to 0.4% for our cooperation with Migros Bank.

ellexx Legal Protection: On the net premiums received from the ellexx portfolio (subscription fees excl. 5% stamp duty), CAP pays us a 10% commission based on the total net subscription fees received.

Independent financial and wealth management advisory services: ellexx receives between 20% and 30% of the fees collected for the various advisory services. If one of the consultations results in an wealth management mandate, ellexx receives between 30% and 40% of the fees.

Groupe Mutuel Optimum Supplementary Insurance: For the conclusion of a supplementary insurance (VVG), Groupe Mutuel AG pays ellexx a one-time commission of 12 monthly premiums.

1. Broker Company and Insurance Branch

ellexx universe AG, Dufourstrasse 18, 8008 Zurich (ellexx), acts as a contractually bound broker of CAP Legal Protection Insurance Company AG (CAP) as well as Groupe Mutuel Services AG and brokers legal protection insurance products and supplementary insurances online on their behalf.

2. Contractual relationship

CAP has an agreement with ellexx as a bound broker. ellexx is remunerated for each policy. Groupe Mutuel has a promotional partnership agreement with ellexx and is remunerated per concluded insurance.

3. Errors, negligence, incorrect information

In the event of errors, negligence, or incorrect information regarding the brokerage of insurance contracts, ellexx and CAP as well as Groupe Mutuel are liable within the framework of the legal provisions.

4. Personal data

Both ellexx and CAP and Groupe Mutuel are committed to taking all necessary measures to ensure compliance with legal data protection regulations. As insurance companies, both CAP and Groupe Mutuel collect and process your relevant personal data to create an insurance offer and to process your policy after purchase. Personal data is usually stored in electronic and/or paper form.
